Policies & Wavier

POLICIES

We have designed these policies in order to give you and your athlete the best possible experience, and to allow us to efficiently and effectively administer all of your needs with our awesome but tiny office staff! We think these policies are fair, and we will try to always be fair and treat you right. Please remember that we are a small business serving the community to the best of our ability. You are agreeing to our policies upon registering for any of our programs. 

All Memberships and Private Training

1. All memberships, and private training sessions are non-refundable, non-exchangeable, and non-transferrable.

2. All memberships, class cards and private training sessions must be paid in advance and in full.  We reserve the right to cancel or reschedule classes and private training sessions at any time to accommodate holidays, special events or the like. No refunds or credit will be granted due to schedule changes. Make up classes will be at the discretion of Gantry Kids & Teens. Private training sessions may be rescheduled if given 24 hours notice. If cancelation is made within the 24 hour period, the training schedule is forfeited.

3. No refunds or credits will be given for unused classes or missed classes. Memberships are auto-renewed. Cancellations require a minimum 30 days written notification to cancel. For example, your membership renews on January 5. You provide noticed of cancelation January 20. Your membership will renew Feb 5 and will be canceled 30 days from your notice, or February 19. 


4. Memberships may be put on hold. The minimum time for a hold is two (2) weeks. The maximum hold is three (3) months. There is a $20 hold fee per month. Members are limited to two (2) holds per membership year. All holds require seven (7) days notice. If your membership renews April 1 and you let us know March 27 that you want a hold, it will be effective in 7 days. Your membership will renew and the hold will begin April 3.

5. Gantry Kids & Teens follows the NYC DOE calendar. In the interest of safety, all programs are canceled when the DOE closes school due to inclement weather or unsafe conditions, manmade or by acts of any God. There are no classes on Thanksgiving and the day after, Christmas Eve and Christmas Day, New Year's Eve and New Year's Day, Easter, Memorial Day, Juneteenth, Independence Day, and Labor Day. If a holiday listed is observed another day, there will be no programs on that day. There are no refunds for closures that result due to the aforementioned.

All Enrichment / After School / Camp Programs / Special Events

1. All Programs must be paid in full thirty (30) days prior to the first day of attendance or in accordance with available payment plans.

2. Registrations made within 24 hours of attendance are subject to availability and an additional fee.

3. After School is a semester commitment, for the duration of the Fall or Spring academic calendar. Sept to Dec Break & January to the last day of school. Registration is for each semester. You do not have to register for the full year. 


4. There are no refunds, credits, transfers or make-ups.


5. Deposits are non-refundable.

6. Camp Programs begin at 9 AM. We have a tight schedule and must depart the gym to meet appointments and transportation timelines! If you are late, you may be left behind. Missed days will not be refunded or credited. Tardiness is discourteous to others and disruptive, so please be on time. 

7. All programs end at 5 PM. After School provides a Walking Bus add-on. Pre-registration is required for the Walking Bus. We understand emergencies happen, please contact Deanna for assistance. Do not contact the coaches directly. Emergency Walking Bus is $30 per day. 


8. There is a late fee for late pick ups. Late pick up fees will be charged for each athlete picked up later than 5 PM. Late fees will be charged to your account at the rate of:

  • $25 - 1st occurrence
  • $50 - 2nd occurrence
  • $100 - 3rd occurrence

We understand emergencies happen, but please do your best to arrive by 5 PM or make arrangements for your athlete if you get stuck. Regardless, please communicate with us ASAP.


9. We are not monsters. Things happen, schedules change, kids get sick and hurt. For our camps, if children are injured and unable to attend our camps because of an extreme physical impairment (broken bones, sprains, or stitches) we will consider a credit depending upon our enrollment numbers, lead time to the event, and injury. There will be a fee for any cancellations. We do not give credits for cancellations made within 48 hours. Illnesses such as colds, fevers, viral infections or the like do not apply.  Acts of any god, weather related cancelations, or simple mistakes with your schedule are also not reasons for refunds.  Again, it is in extreme cases that we reserve the right to consider giving credits, but again, there is a fee for canceling.  We are a small business, staff for the number of kids enrolled, and cancellations and requests for credits impact us greatly both for the current event and the future event you plan to attend.


Behavior 

We know that last few years have taken a toll on families, especially young children. They lost the opportunity to learn some social skills as well as emotional regulation and expression. Gantry Kids & Teens is an amazing place for children who have a lot of energy and love to move their bodies. That said, we do not have the ability to provide special care or counseling to children who thrive best in small groups, one-on-one situations, or who have a difficult time transitioning from one activity to another. We do not tolerate children who are physically aggressive towards other children as a baseline of problem solving or are physically aggressive towards adults. This includes our coaches. Your child needs to respect the gym, our rules and our coaches. 


As per our waiver:  The minor participant and parent or guardian understand that payment for all products, services and special programs is required in full at the point of sale and that all sales are final, all payments for products and services are non­refundable, and services are not transferrable. The minor participant and parent or guardian understand that Gantry Kids & Teens reserves the right to terminate enrollment in any program or membership at any time. If such termination is due, in the sole judgment of Gantry Kids & Teens, to the minor participant’s unsafe, disruptive, uncooperative, negligent, reckless or otherwise improper acts or omissions of, or violation of any policy or rule of Gantry Kids & Teens, the minor participant, and parent or guardian understand that all amounts previously paid will be forfeited.

WAIVER

All participants must sign a waiver. 

  1. The minor participant and parent or guardian represent that the minor participant below is physically capable of participating in exercise and other programming provided by Kelber Coaching, LLC (also known as “Gantry Kids & Teens”) and its directors, officers, members, employees, agents, affiliates, representatives, successors, assigns and instructors (collectively herein, “Gantry Kids & Teens”.) The minor participant and parent or guardian understand that physical exercise can be strenuous and subject to the risk of serious injury and further understand that no exercise/activity program should be undertaken without the consent of a medical doctor and they are responsible for undertaking to obtain such consent.
  2. The minor participant and parent or guardian agree that if the minor participant engages in any physical activity, or uses any Gantry Kids & Teens amenity, on the premises or off premises, including any sponsored Gantry Kids & Teens event or camp, he or she does so ENTIRELY AT THE RISK OF THE MINOR ATHLETE AND PARENT OR GUARDIAN. Any recommendations for changes in diet are entirely the responsibility of the minor participant and parent or guardian and they will undertake to consult a physician prior to undergoing any dietary changes.
  3. The minor participant and parent or guardian agree that the minor athlete is voluntarily participating in the activities provided, directly and indirectly, by Gantry Kids & Teens and the use of facilities and premises provided and ASSUME ALL RISK of injury, illness or death.
  4. The minor participant and parent or guardian agree that Gantry Kids & Teens is not responsible for any loss of, or damage to, personal property.
  5. The minor participant and parent or guardian understand that the exercises provided by Gantry Kids & Teens may be extremely demanding and take full responsibility for knowing, monitoring and acting within their abilities and learning and incorporating any modifications or adaptations necessary to proceed with such activities in a safe and appropriate manner, under the direction of Gantry Kids & Teens or their own discretion.
  6. The minor participant and parent or guardian agree that Gantry Kids & Teens shall not be liable or responsible for any injuries to the minor participant which may occur as a result of (a) his or her use of all amenities and equipment provided by Gantry Kids & Teens on or off premises, and his or her participation in any activity, class, program or instruction, (b) the sudden and unforeseen malfunctioning of any equipment, on or off premises, (c) Gantry Kids & Teens’s instruction, training, supervision or dietary recommendations, and (d) his or her slipping and/or falling while in the facility, or on Gantry Kids & Teens’s premises, including adjacent sidewalk areas, or while participating in events, camps and activities on or off premises, while under the supervision of Gantry Kids & Teens.
  7. The minor participant and parent or guardian acknowledge that they have read this Waiver & Release and understand that it is a RELEASE OF ALL LIABILITY.
  8. The minor participant and parent or guardian expressly agree to release and discharge Gantry Kids & Teens from any and all claims, causes of action or judgments that may arise out of any of the events noted in numbers 1 through 7 above and they agree to voluntarily forfeit or waive any right that they may otherwise have to bring legal action against Gantry Kids & Teens for personal injury or property damage. To the extent that statute or case law does not prohibit release for ordinary negligence, this release applies to any ordinary negligence on the part of Gantry Kids & Teens.
  9. The minor participant and parent or guardian grant Gantry Kids & Teens permission to use the minor participant’s likeness in photograph and video in any and all of its publications and in any and all other media, in perpetuity, and for other use by Gantry Kids & Teens. The minor participant and parent or guardian will make no monetary or other claims against Gantry Kids & Teens for the use of such photograph and video.
  10. The minor participant and parent or guardian understand that payment for all products, services and special programs is required in full at the point of sale and that all sales are final, all payments for products and services are non­refundable, and services are not transferrable. The minor participant and parent or guardian understand that Gantry Kids & Teens reserves the right to terminate enrollment in any program or membership at any time. If such termination is due, in the sole judgment of Gantry Kids & Teens, to the minor participant’s unsafe, disruptive, uncooperative, negligent, reckless or otherwise improper acts or omissions of, or violation of any policy or rule of Gantry Kids & Teens, the minor participant, and parent or guardian understand that all amounts previously paid will be forfeited.
  11. The minor participant and parent or guardian agree to the policies set forth by Gantry Kids & Teens (gantrykids.com/policies)


By signing this waiver and release, I acknowledge that I have read it and understand all of its terms. I agree that I am executing this waiver and release on behalf of myself and on behalf of the minor participant. I execute it voluntarily and with full knowledge of its significance. I expressly agree that this release shall be binding upon my heirs, executors, administrators and assigns. I am over 18 years of age and I am the parent or legal guardian of the minor participant.

HEALTH AND WELLNESS PRACTICES

For our families:

  • Please perform your own health check at home each day before leaving for the gym or sending your child to school
  • Keep children home if any family member is sick with any contagious illness, or if the athlete or anyone in their family has recently been exposed to someone who tested positive with COVID-19 
  • Children who test positive for COVID-19 may return to the gym after the allocated time mandated by the CDC and state and local government 
  • Keep children home if they present with a fever, viral infection, upper respiratory infection, vomiting, diarrhea, an eye infection, or a rash until these symptoms subside, unassisted by medications for 24 hours. Children with colds who cannot pick their heads up should be at home. Children coughing continuously should also be home. 
  • If your child does not attend school for any reason, they may not attend after school or other programs on that day. This includes absences due to illness, vacation, mental health or just a day playing hooky.


Enrollment in our programs means you consent to our policies and waiver, and agree to any fees that may be incurred or forfeited.
